By doing so, you represent and warrant that you have the legal right and capacity to enter into these Terms in your jurisdiction. Where these Terms have been translated into other languages, the English language version takes priority in the event of any inconsistency or conflict.

1. Information About Us

1.1 Our Site is owned and operated by Fantasy Sports Plays, a limited company registered in India under 10888983, whose registered address is at 6/78, Block-B, Sector 4, Near, Malviya Nagar, Jaipur, Rajasthan 302017 (“we/us/our”).

2. Access to and Use of our Site

2.1 Access to our Site is free of charge and it is your responsibility to make any and all arrangements necessary in order to access our Site.

2.2 Certain parts of our Site (including the ability to participate in Competitions) may require an account in order to use them. You will also be required to deposit funds in your account before placing real money into a Competition. Users are only permitted to hold one account with us; opening multiple accounts is strictly prohibited.

2.3 We may require you to provide us with certain information including your name, contact details, date of birth, payment and bank details, proof of identity, location and residence. We may also take steps to verify your creditworthiness with third party credit reference agencies and you hereby agree to us or such credit reference agencies processing, using, storing and disclosing personal information you provide us with in connection with your registration.

2.4 When creating an account, the information you provide must be truthful, accurate, current and complete. If any of your information changes at a later date, it is your responsibility to ensure that your account is kept up-to-date. If you submit any information that is false or deliberately misleading, we may suspend your use of the Site or Service, or stop it completely.

2.5 You must treat all identification codes, passwords and other security information as confidential. If we think you have failed to keep confidentiality, we are allowed to disable any security information (including your passwords and codes). You must not create accounts with the Site through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper

2.6 You must not create an account for anyone other than yourself, and you agree that you will not sell, transfer, license or assign your account, username, or any account rights. You agree that you will not solicit, collect or use the login credentials of other users.

2.7 Access to our Site is provided “as is” and on an “as available” basis. We may alter, suspend or discontinue our Site (or any part of it) at any time and without notice. We will not be liable to you in any way if our Site (or any part of it) is unavailable at any time and for any period and we reserve the right to restrict or suspend account activity and withdraw or void any Competitions in these circumstances.

2.8 Use of our Site is subject to our Terms and Conditions of Website Use. Please ensure that you have read them carefully and that you understand them.

2.9 You may only use the Site and Service as permitted by law and these Terms. If you fail to comply with the law or these Terms, we may suspend or terminate your use of the Site or Service and deactivate your account.

2.10 You must not attempt to restrict another user from using or enjoying our Service and you must not encourage or facilitate any violation of these Terms or any of our other terms.

2.11 You may close your account at any time by contacting us at support@sportjunki.com, providing your account does not show a balance due. In these circumstances, you must settle the balance owing before we close your account. Following account closure, suspension or termination we will generally return any funds in your account to you unless these Terms or the law or any regulatory, enforcement or governmental authority requires us to retain them.

3. Restricted Users

3.1 You may only apply to participate in Competitions for real money if you are at least 18 years of age (or older where the minimum age for use of our Service in your jurisdiction is over 18) and, by doing so, you represent and warrant that you are at least this age.

3.2 Underage gaming for money is a criminal offence and we reserve the right to take such steps as we deem necessary if we become aware that you are or were underage when entering a Competition, including but not limited to barring you from entering into any further Competitions, preventing you from making withdrawals from your account, retaining any winnings credited to your account and demanding that any winnings withdrawn by you are paid to us.

3.3 Competitions which do not involve real life money may be entered into by players aged eighteen years and older. Any registration by, use of or access to the Site or Service by anyone under the age of 18 is unauthorised and is in breach of these Terms.

3.4 The following categories of people are also prohibited from entering into any Competition on the Site:

3.4.1 Employees and contractors of Fantasy Sports Plays;

3.4.2 Professional athletes who are listed as players in our Competitions;

3.4.3 Any individual who may be able to influence a game or who has access to any pre-release data or other information regarding the performance of any team or players appearing in our Competitions which may place that individual at an advantage with respect to the general public (including but not limited to team agents, coaches and other sports officials); and

3.4.4 The spouse, partner or any relative who resides at the same address as any individual listed in any of the above categories.

3.5 By using our Service and entering into any Competitions, you represent and warrant that you are: (a) of sound mind, capable of taking responsibility for your actions; (b) not a person barred from using our Service under the laws of any other applicable jurisdiction; and (c) not the subject of bankruptcy or other insolvency procedures (such as the entry into of a formal or informal arrangement with creditors) or any other event analogous to the foregoing in any jurisdiction.

3.6 If you are located in particular jurisdictions, we reserve the right to block you from using our Site or Service and from entering into any Competition. It is your responsibility to ensure that you are permitted to game with us based on the jurisdiction of your location, residence or domicile. By accessing or making use of the Site or Service, you warrant that such activity is not illegal in the territory in which you are based or located. In the event a Contestant indicates, while submitting an address, that he/she is a resident of either one Assam, Odisha, Sikkim, Nagaland or Telangana, such Contestant will not be authorized to continue to sign up for the match, league tournament or contest and may not contribute in any paid version of the Contest(s).

If it is noticed that a contestant playing the paid formats of the Contest(s) is a resident of Assam, Odisha, Sikkim, Nagaland or Telangana states, SportJunki shall eliminate such applicant and forfeit any prize won by such participant.

3.7 The Site does not constitute an offer, solicitation or invitation by us for the use of our Service in any jurisdiction in which such activities are prohibited by law.

4. Competitions, Entry Fees and Availability

4.1 We offer a number of different styles and formats of Competition, including daily, single match and season long formats, and public arena, private arena, head-to-head, knock-out, ‘beat the boss/sporting celebrity’ and free to play options. We also offer various different selection models, including, team, multi-entry, tier, quickplay, standard play, and beginner/rookie only. 4.2 Competitions are generally initiated by users creating a new league or joining an existing league on the Site. From time to time we may also run featured Competitions on the Site. If any Competition requires an entry fee in order to participate, this will be made clear in advance.

4.3 We deduct an entry fee paid by each player for a Competition in order to cover our overheads, operational and administration costs for the provision of our Service (“Commission”). The Commission is calculated by:

• Reference to the size of the Competition and the exact amount will be made clear to you during the entry process.

4.4 Participants score fictional points based on the performance of the players they have drafted in real-life sports matches (a “Match”), which determines their ranking in the fixed period of the Competition.

4.5 Competitions are contests of skill, determined by objective criteria described in the specific Competition rules. Participants use their skill and knowledge of sports information and fantasy sports rules to accrue as many points as possible, based on the scoring criteria.

4.6 If you wish to participate in a Competition, our Site will guide you through the entry process and will notify you of any additional sport-specific advice, conditions of play, rules or scoring systems which apply or relate to the Competition you have entered. You agree to comply with any such additional rules if you enter any Competition, so we strongly encourage you to read any such rules prior to participating.

4.7 We may in our sole discretion create promotional codes from time to time that may be redeemed for features and credits as advised depending on the corresponding promotion. Such codes may only be used by the account holder to which they relate and may not be sold, transferred, exchanged for points or otherwise used in breach of any terms which apply thereto. Such codes must be redeemed before their expiry date and we reserve the right to discontinue, withhold or withdraw such codes as necessary from time to time.

4.8 The closing time of any Competition you enter shall be notified to you in advance and it is your responsibility to pick your players before the expiry of this period. If you fail to do this, you will only accrue points for players you have selected within the time limit.

4.9 We neither represent nor warrant that our Service (or any individual Competitions) will be available at all times. We use our best efforts to generate accurate player lists but we accept no responsibility for inaccuracies therein during the selection stages or for the subsequent unavailability of players included in lists.

4.10 We reserve the right to change, suspend or discontinue any Competitions, and change and modify fees charged, and to institute new fees at any time, upon reasonable notice given to you in advance. Changes in entry fees will not affect any sums that you have already paid.

4.11 If any Competition is cancelled for whatever reason, no payment shall be taken under normal circumstances. If we have taken an entry fee any such sums (including the Commission thereon) will be refunded to you without undue delay. Any refunds due under this Clause (or any other Clause) will be made using the same payment method that you used when making payment.

4.12 Participants acknowledge and agree that they may enter only one Team in any Contest offered in relation to a Sport Event. In case of Multiple Entry Contest(s), a Participant may enter more than one Team in a single Multiple Entry Contest. In addition, it is expressly clarified that SportJunki may, from time to time, restrict the maximum number of Teams that may be created by a single User account (for each format of the contest) or which a single User account may enter in a particular Multiple Entry Contest, in each case to such number as determined by SportJunki in its sole discretion.

4.13 Confirmed contests shall become operational only when a minimum of two users join a Confirmed Contest.

4.14 SportJunki shall use best efforts to rectify such error prior to the distribution of prizes. However, SportJunki hereby clarifies that it relies on the accuracy and completeness of such third party score/statistic feeds and does not itself warrant or make any representations concerning the accuracy thereof and, in any event, shall take no responsibility for inaccuracies in computation and tabulation of fantasy points or the selection of winners.

5. Deposits and Withdrawals

5.1 We may impose limits on the maximum amount users may deposit into their accounts within a defined period. Deposits can be made by credit or debit card in your name and may take 24 hours before they appear in your account and you are able to use them to start gaming.

5.2 We do not charge any additional fees for any of the payment methods listed above but foreign exchange conversion fees may apply between different currencies. Where such fees apply you will be notified on the Site.

5.3 By making any payment or depositing money into your account, you confirm that such monies are authorised, ‘clean’ and do not originate from any illegal source or activity. You also confirm that you will not reverse or cause to be reversed any payment made into your account with a view to evading any legitimate liability.

5.4 All funds deposited by users when playing Competitions for money will be held by us in a segregated client account. Before holding money on your behalf for these purposes, we are required to comply with the Reserve Bank of India, Enforcement Directorate and SEBI authority and to verify client identities. You warrant and represent that any proof of identity or other document, data or information you provide us with for these purposes shall be accurate, current and complete.

5.5 Money staked or deposited with us is held on your behalf to meet any payment obligations you may incur as a consequence of entering into any Competition and may not be used by us to cover our operating expenses or for any other purposes. Money we hold on account for you is not insured, guaranteed or otherwise protected in the event of our insolvency.

5.6 Users with credit on account shall not receive any interest on deposited monies.

5.7 Provided you have satisfied any identification verification procedures we have in place; you may withdraw funds from your account at any time. To do this, you should follow the prompts on the withdrawals page. Withdrawals must be credited to a bank account in your name and are only processed after 3 days of your request. This delay helps us to maintain your account security, comply with our anti-money laundering requirements and protect against collusion and fraud.

5.8 It is your responsibility to report winnings and losses and to account for any tax or other duty imposed on you as a result of any Competition in which you participate and you agree to indemnify us from and against the same.

5.9 A User shall be permitted to withdraw any amounts credited into such User's 'Unutilized' Account for any reason whatsoever by contacting SportJunki Customer Support. All amounts credited into a User's 'Unutilized' Account must be utilised within 335 days of credit. In case any unutilised amount lies in the 'Unutilized' Account after the completion of 335 days from the date of credit of such amount, SportJunki reserves the right to forfeit such unutilised amount, without liability or obligation to pay any compensation to the User.

6. Prizes, Results and Settlement

6.1 Unless otherwise notified by us, players are free to decide if they want to play for guaranteed prizes by defining an entry fee per player at the creation of the Competition. Certain Competitions are guaranteed to have a predetermined prize pot or product to be won, whereas other Competition winnings and prizes will depend on the number of entries into that particular Competition (and the winnings/prizes will always be made clear to you during the entry. process). If success in a Competition results in a prize, the rules will dictate whether the winner takes all or whether other ranked players receive a proportion of the prize money invested by the participants in that Competition.

6.2 Winners are announced and Competitions are settled on our confirmation of the scores and results. Prizes are added to a player’s account balance and our decision regarding the determination of any winner(s) is final and binding.

6.3 In the event that two or more participants tie in the number of points scored in a Competition, they shall each receive an equal proportion of the prize money for that tied position.

6.4 We use our best endeavours to credit any winnings (minus our Commission) to player accounts within 24 hours or within any payment schedule notified to you in respect of any particular Competition. In the event of any mistaken or incorrect pay-out, we reserve the right to rectify or reverse the settlement.

6.5 We take appropriate steps to prevent unauthorised withdrawals from user accounts. If you believe that any of your funds or transactions have been misallocated, mishandled or compromised, please notify us immediately.

6.6 You agree to notify us immediately if you become aware that any sum has been incorrectly credited to your account. In these circumstances you agree to forfeit any such amounts and we shall be entitled to reverse such credits or recover sums owing from you, including by withholding or reversing any winnings.

6.7 SportJunki shall not permit a Winner to withdraw his/her prize(s)/accumulated winnings unless the above-mentioned documents have been received and verified within the time-period stipulated by SportJunki. The User represents and warrants that the documents provided in the course of the verification process are true copies of the original documents to which they relate.

7. Refunds and Cancellation

7.1 Upon joining a contest, any submitted entry fees will not be refundable.

7.2 In such a case a user defined contest or non-guaranteed points contest remains unfilled, it will be cancelled and all the entry fees will be refunded within 24 hours, 10% of which will be deposited into the users ‘Points Bonus’ wallet.

7.3 We reserve the right to cancel Competitions at any time. No points shall be scored for Matches that are abandoned, cancelled or postponed and participants shall receive a full refund of any entry fee(s) paid by them for that Competition (subject to these Terms)

7.4 SportJunki may, in certain exceptional circumstances and at its sole and absolute discretion, refund the amount to the User after deducting applicable cancellation charges and taxes at the time of the transaction.

8. Provision of our Service

8.1 As required by law, we will provide our Service with reasonable skill and care, consistent with best practices and standards in the gaming industry, and in accordance with any information provided by us about our Service and about us.

8.2 If we require any information or action from you in order to provide our Service or set you up with an account, we will inform you of this as soon as is reasonably possible. If the information you provide or the action you take is delayed, incomplete or otherwise incorrect, we will not be responsible for any delay caused as a result.

8.3 Although it is our intention for the Site to be available as much as possible, there will be occasions when it may be suspended or otherwise interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. Unless the issue is an emergency that requires immediate action, we will inform you in advance by posting a notice on our Site before or upon suspending or interrupting our Service.

9. Posting Content

9.1 You may only use our Site and Service in a manner that is lawful and that complies with the provisions of these Terms. Specifically, you must ensure that you comply fully with any and all applicable local, national, and international laws and/or regulations and never use our Site or Service in any way, or for any purpose, that is unlawful or fraudulent.

9.2 If you contact other users of our Site (via user forums or otherwise) or upload material to the Site, you must adhere to the standards set out in Clause 8.5. We will not be legally responsible to anybody for the accuracy of material that you upload to the Site, and we can remove it at any time if we determine (in our sole discretion) that it does not comply with our content standards.

9.3 You are solely responsible for your conduct and any materials (including photos, data, text, files, information, usernames, images, graphics, audio and video clips, applications, links, messages and other content or materials (collectively, "Content")) that you submit, post, transmit or display on or via the Site. For the avoidance of doubt, we do not accept any responsibility or hold any liability for any interactions between users and you rely on other user Content solely at your own risk.

9.4 You agree to only use our Service for legitimate gaming and at all times to act in good faith in relation to other users with whom you interact or participate in Competitions via the Site. Any form of collusion or manipulation is strictly forbidden.

9.5 Any Content you submit or transmit to the Site or via the Service must not be defamatory, discriminatory, sexually explicit, obscene, harmful to minors, offensive, hateful, inflammatory or likely to deceive, harass, annoy, alarm, threaten, inconvenience upset or embarrass anybody else or invade their privacy. Your Content and actions on the Site must not:

· be used to impersonate anyone, or misrepresent anyone's identity;

· imply any form of affiliation with us where none exists;

· encourage or assist anything that breaks the law;

· be in breach of any legal duty owed to a third party including, but not limited to, contractual duties and duties of confidence;

· contain any false, misleading or deceptive statements or any information intended to manipulate a competition;

· be adverse to the operation of the Site or detrimental to other users;

· attempt to influence the outcome or play in any Match;

· be detrimental to our business activities or result in any legal liability for us or third parties;

· involve the uploading to the Site of any viruses, malicious code or the carrying out of anything designed to disable, disrupt, or in any way interfere with the proper functioning of the Site, the Service, or the equipment or network on which they operate;

· reproduce, adapt, translate, reverse-engineer, decompile, decode, decrypt or disassemble the Site (or any part of it) or disguise your IP address;

· use the Site or Service for commercial purposes, including uploading or posting any content that is commercial in nature, or that can be characterised as spam;

· use our data or statistics for any commercial purpose or, if you are a competitor company, for any purpose; or

· try to advertise or promote products or services.

9.6 We are not required to pre-screen user content or moderate our interactive services. We will not be responsible for any loss to anyone who does not use our Site according to our standards (whether or not we have moderated the service).

9.7 You grant us an irrevocable, perpetual, non-exclusive, fully paid and royalty-free, transferable, sub-licensable, unrestricted, worldwide license to the Content that you post on or through the Site, to reproduce, distribute, sub-license, modify, edit, adapt, translate, create derivative works of, publicly display, transmit, broadcast or otherwise exploit all or any portion of this material, for any purpose, in any and all media now known or later developed (subject to our Privacy Policy).

9.8 You waive all rights to any claim against us for any actual or alleged infringement of any proprietary rights, rights of privacy or publicity, moral rights, and rights of attribution in connection with your Content.

9.9 You represent and warrant that: (i) you own the Content posted by you on or through the Site or otherwise have the right to grant the rights and licenses set out in these Terms; (ii) the posting and use of your Content on or through the Site does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; and (iii) you agree to reimburse and indemnify us for any costs or expenses we incur as a result of any breach of this provision.

10. Breach of these Terms and Illegal Activity

10.1 If we suspect that you have breached these Terms, or if requested by any legal enforcement, gaming or taxation authority, we will take whatever steps we and/or they deem are necessary, including but not necessarily limited to stopping your use of the Site and/or Service, temporarily or permanently suspending your account and account activity, disqualifying you from any Competition you have entered, removing any Content you have posted on the Site, sending you a warning, taking legal action, and informing the appropriate authorities. We hereby exclude any and all liability arising out of any actions (including, but not limited to those set out above) that we may take in response to breaches of these Terms.

10.2 In addition to the remedies set out in Clause 10.1, we reserve the right to withdraw or void your entry fees, or withhold or seize any or all of your winnings and account funds in the event that we suspect you have breached these Terms, cheated, engaged in money laundering activities, or may be having problems securing credit, or if there is any ongoing investigation involving a suspected breach of these Terms or any criminal, dishonest or fraudulent activity. We may report any suspicious transactions, conduct or gaming patterns to the appropriate authorities in our sole discretion.

10.3 All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, warranty disclaimers, indemnities and limitations of liability.

11. Our Liability

11.1 To the fullest extent permissible by law, we accept no liability to any user for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) our Site or the use of or reliance upon our Service.

11.2 We provide our Service for domestic and private use or purposes only. We make no warranty or representation that our Service is fit for commercial or business purposes of any kind. We will not be liable to you for any loss of profit, loss of business, interruption to business or for any loss of business opportunity.

11.3 The opinions, views, and values expressed in the Content of other users (on our forums, message boards and otherwise) are those of the authors of that content and do not necessarily represent our opinions, views, or values. Nothing on our Site constitutes advice on which you should rely and it is provided for general information purposes only.

11.4 We are not responsible for incomplete, illegible, misdirected or stolen entries. To the fullest extent permitted by the laws of the jurisdiction in which we operate, we also exclude legal responsibility for any loss to you arising from use of our Site or Service including from viruses, bugs or other technical malfunction, the failure of any software or equipment that impedes the operation of our Service or the placing of entry fees, or for delays and disruptions on the Site, a suspension or other action taken with respect to your account, and for any loss of actual or anticipated income, loss of revenue, loss of goodwill and reputation, loss of anticipated savings, loss of use, loss of data, increased costs and expenses, wasted expenditure and any indirect, special and consequential damages, arising as a result of your use of the Site or Service, whether or not such loss or damage is foreseeable, foreseen or known.

11.5 We make reasonable efforts to ensure that the data, scores, statistics, results, times and other content and material appearing on or forming part of our Site and Service is complete, accurate, and up-to-date. We do not, however, make any representations, warranties or guarantees (whether express or implied) in this respect. Any results of scores we provide are based on information received from our third party data providers, and are solely for guidance and may contain errors or omissions. We reserve the right to suspend any Competitions and void any entry fees in the event that we become aware that we have published any inaccurate information pertaining to a Match or Competition.

11.6 We exclude, as far as legally possible, all terms and representations, warranties, and guarantees implied by law or by statutes that may apply to our Site or Service. In particular, we do not make any representations or warranties of any kind that our Site will meet your requirements, that any specific results will be achieved through use of our Service, that it will not infringe the rights of third parties, that our Site and Service will be compatible with all software and hardware, or that it will be secure, complete or fit for any purpose. You acknowledge that you risk losing money by engaging in real money play through our Service and that such sums will not be recoverable from us.

11.7 Our total legal responsibility to you will not exceed the amount you have paid (if any) to us for use of the Site or Service during the previous six-month period.

11.8 Nothing in these Terms seeks to exclude or limit our liability for death or personal injury caused by our negligence (including that of our employees, agents or sub-contractors), for fraud or fraudulent misrepresentation, or for anything else which may not be legally excluded.

12. Indemnity

12.1 You agree to indemnify us and our associated companies, affiliates, officers, directors, agents and employees on a continuing basis from and against all liabilities, costs, claims, losses, expenses (including our legal fees) or awards in connection with a claim by any third party (including another user of the Site) arising out of your use or misuse of the Site or Service, any Content that you upload, post or transmit to or through the Site, your breach of these Terms, your receipt, use or misuse of any prize monies, reliance on any inaccurate information provided by you, your dealings with any third party or other user of the Site, or your breach of any laws, rules, regulations or code of conduct.

12.2 You shall give us such assistance or information as we request in relation to such claim. Such assistance and/or information shall be given promptly. We have the right to assume the care and conduct of contesting any such claim.

13. Events Outside of Our Control (Force Majeure)

13.1 We will not be liable for any failure or delay in performing our obligations, or for any cancellation or suspension of our Service, where that failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action by third parties, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, epidemic or other natural disaster, or any other failure or delay caused by a third party or any other event that is beyond our reasonable control.

14. Communications from us

16.2.2 Administer your account and process your entry (including payment) for any Competitions; and

16.2.4 Investigate the breach or suspected breach of these Terms or of the rules or integrity of a Competition.

16.3 By entering into a Competition, you hereby authorise us to use your name, voice, likeness, location and profile picture in our advertising and promotional materials. In these circumstances, we will notify you before doing this.

16.4 We reserve the right to record and monitor any telephone calls made between you and us.

16.5 We will never pass on your personal information to any third parties without first obtaining your express permission.

17.6 If any of the provisions of these Terms are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms and the remainder of these Terms shall be valid and enforceable.

17.7 No failure or delay by us in exercising any of our rights under these Terms means that we have waived that right, and no waiver by us of a breach of any provision of these Terms means that we will waive any subsequent breach of the same or any other provision.

17.8 We may change these Terms from time to time and where this happens we will inform you and you will be required to agree to the changes before you next sign in to the Site. Any changes are binding on you and if you do not agree to the changes you will not be permitted to continue using our Service.

18. Law and Jurisdiction

18.2 Any disputes concerning these Terms, the relationship between you and us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the non-exclusive jurisdiction of the courts of India.
